JUDGEMENT

- (1.) Seeking direction upon the respondentJharkhand Academic Council for publishing the result of the petitioners for the Teachers Eligibility Test, 2012 for Class 1 to 5 (Assistant Teacher), the present writ petition has been field.
(2.) Pursuant to Advertisement No.95 of 2012 dated 18.11.2012 the petitioners appeared in the examination for Teachers Eligibility Test 2012 held on 26.04.2013. The result was published on 28.05.2013. The petitioner nos. 1 and 3 were declared unsuccessful on the ground 'Wrong Roll No' and the petitioner no. 2 was declared unsuccessful on the ground 'Non Compliance of TT Course'. The learned counsel for the petitioners submitted that due to technical mistake petitioners have been declared failed. The petitioner nos. 1 and 3 have correctly darkened the right columns but in some places on the OMR Sheet the darkening was not uniform and for that defect the petitioners' result should have not been rejected. It is submitted that the petitioner no. 2 submitted his TT certificate through speed post to the office of Jharkhand Academic Council on 09.05.2013 however, he has been declared fail due to non compliance of TT course.

The learned counsel for the Jharkhand Academic Council reiterates the stand taken in the counteraffidavit and submits that the petitioner nos. 1 and 3 have not darkened the circles correctly in the OMR Sheet with respect to their roll number. The OMR Sheet was evaluated through the computer which reads the darkened circles only. As the petitioner nos.1 and 3 did not darken the circles of their roll numbers correctly in the OMR sheet, their OMR sheets could not be identified by the computer and therefore their result is shown 'rejected' due to 'Wrong Roll No'. It is stated that the entire process of scanning and evaluation is automatic and there is no manual intervention. The learned counsel for the respondent Jharkhand Academic council further submitted that so far as the petitioner no.2 is concerned, he was allowed to appear in the Teacher Eligibility Test, 2012 examination on the condition to submit training certificate/ mark sheet in the office of the Council within the fixed period through speed post compulsorily,failing which the candidature shall deem to be rejected. It is stated that vide Communique no. 22/2013 Council directed all concerned candidates to submit their certificate on or before 13.05.2013 and again vide Communique no. 25/2013 they were permitted to submit certificate in PDF format and upload the same in the JAC website till 24.05.2013. The certificate/marksheet of the petitioner no.2 has not been received in the council and therefore his result is shown 'rejected' due to 'Non Compliance of TT Course'.;
