JUDGEMENT
M.Y.EQBAL, J. -
(1.) THIS is another instance of highhandedness on the part of the authorities of the respondents who are rejecting the genuine and bona fide claim of the widow of the workman, who died in harness while doing work in the underground mines. The object of compassionate appointment is to give immediate relief to the widow/dependent of the poor employee in class IV post. How the authorities of the respondents while giving such appointment asked the widow to fulfill the conditions relating to her height? In similar circumstances this Court passed the following orders in W.P.S. No. 2403 of 2005 :
"Heard the parties.
Petitioner is aggrieved by the order dated 18/19.3.2005 whereby her claim for compassionate appointment has been rejected.
Petitioners husband while in service of respondent died in harness on 14.8.2003. Petitioner applied for compassionate appointment immediately after the death of her husband on 19.12.2003. After six months petitioner was asked to appear before the Medical Board. She appeared before the Medical Board and thereafter a decision was taken in 2005 and communicated to the petitioner by letter dated 18.3.2005 refusing to appoint the petitioner/ widow on compassionate ground only on the ground that as per M.A.T. Rules her height is less than the height prescribed therein. It is a matter of great surprise that a widow seeking compassionate appointment for class IV post but her claim is rejected merely on the ground that her height is less as per the requirement of the Medical Board. In my opinion, the impugned order cannot be sustained in law.
This writ application is, therefore, allowed and the impugned order is quashed. The respondent -authority is directed to appoint the petitioner on compassionate ground within a period of two months from the date of receipt/ production of a copy of this order."
(2.) THE authorities of the respondents should not ignore the orders passed by the Court unless reversed by the higher Courts and the authorities of the respondents are bound to follow the rule of law which includes the judgments passed by the High Courts and the Supreme Court.
I, therefore, direct the respondents to appoint the petitioner on compassionate ground within a period of two months from the date of receipt/production of a copy of tills order.;
