JUDGEMENT

(1.) 2001 (2) JLJR 213. In the said case though there was a delay of about 17 years he was permitted to correct the date of birth recorded in the service book.
(2.) HOWEVER , after hearing counsel for the parties, I am not inclined to accept this submission as made on behalf of the petitioner for the grounds mentioned hereinunder.
Admittedly, the petitioner was appointed in the service of the State on 19.8.1955 whereinafter his service book was opened. The date of birth has already been recorded therein and the signature and thumb impression of the petitioner was taken. While in service passed the Matriculation examination in the year 1973 and was provided with the certificate. In the said certificate a different date of birth as 3rd May, 1948 was shown. It has not been made clear by the petitioner as to why he gave a different date of birth while appeared in the matriculation examination though a separate date of birth was given while his service book was opened. Even thereafter for 30 years the petitioner did not choose to move before the competent authority to correct his date of birth on the basis of matriculation certificate as was issued in the year 1973. Now after about 40 years of the service and 32 years of passing of matriculation examination he wants to change his date of birth after retirement, which is not permissible.
(3.) SO far as retirement benefit is concerned the petitioner may move separately before the authority concerned who will decide the claim.;
