JUDGEMENT

(1.) HEARD counsel for the parties.
(2.) THE petitioner, who is said to be son of late Bhutan Mahli, a Sweeper in Netarhat Residential School, Latehar, who died on 01.12.2012 in harness, has sought compassionate appointment in his place. According to the petitioner, he had made representation through Annexure -2 Series dated 04.02.2013, thereafter he has moved this Court.
(3.) LEARNED counsel has appeared on behalf of respondent -Netarhat Vidyalaya and stated on the basis of instruction contained in the counter affidavit that the Executive Committee of this Samiti in its meeting dated 31.12.2013 has resolved to constitute a compassionate appointment committee to screen and take decision with regard to the pending matters for appointment of candidates on compassionate grounds as per the guidelines and bye -laws of the school. Subsequently, the Principal has been authorized to constitute such a Committee as per the meeting held on 01.03.2014 and finalize the matters relating to compassionate appointment at the earliest preferably before the next meeting of Executive Committee.
Respondents have taken a plea that the petitioner had made application on 15.02.2013 after the death of the employee on 01.02.2012 without relevant documents and he has finally furnished the documents on 03.10.2013. According to the respondents, the decision would be taken up shortly in accordance with law after consideration of the Compassionate Appointment Committee.;
