JUDGEMENT

(1.) 02/21.05.2014 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State.
(2.) THE petitioners are father -in -law and mother -in -law of the complainant/informant, who have been implicated in connection
with Baharagora P. S. Case No. 46 of 2014 corresponding to
G. R. Case No. 218 of 2014 registered under Sections
498A/406/324/109/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act pending in the Court of learned
Judicial Magistrate, 1st Class, Ghatsila.
Learned counsel for the petitioners submits that prior to institution of complaint, which led to institution of the instant
FIR complainant had also given written report to women cell,
Baharagora in which general allegations have been made
against the accused persons. It is further stated that prior to
that husband of the complainant had filed a Matrimonial Suit
being Matrimonial Suit No. 426 of 2013 on 02.09.2013 before
the Principle Judge, Family Court, East Singhbhum at
Jamshedpur for restitution of conjugal rights which, however,
did not succeed. It is also stated that an informatory petition
being Informatory Petition No. 31/13 dated 16.08.2013 was also
filed before the learned ACJM, Ghatsila, East Singhbhum,
Annexure -2, with an apprehension that husband and other
family members could be implicated in a false case by the
present complainant. It is submitted that after series of legal
notices by one or other parties, the instant FIR has been lodged
by the complainant, which also contains general allegation. The
petitioners are old aged father -in -law and mother -in -law,
therefore, they may be enlarged on bail otherwise they will be
subjected to unnecessary incarceration.
(3.) LEARNED counsel for the State has opposed the prayer for anticipatory bail of the petitioners.;
