JUDGEMENT

(1.) HEARD learned counsel for the parties. The petitioner's -husband, namely, Late Kameshwar Hari is said to have died on 31st March, 2008 while serving as Sweepar in Katras Circle under the respondent -Mineral Area Development Authority, Dhanbad.

IT is submitted on behalf of the petitioner that death -cum -retiral dues and other service dues of her deceased husband have not yet been paid despite representations made by her before the respondent -authorities of M.A.D.A. vide Annexures -2 and 3 series. Learned counsel for the respondent -M.A.D.A. submits that if the petitioner approaches the competent authority under the respondent -M.A.D.A. with a fresh representation, her grievances shall be looked into and redressed in accordance with law as per the scheme framed for retired employees.

HAVING heard learned counsel for the parties, since me matter relates to death -cum -retirement dues of the deceased employee, at this stage, without making any comments upon the claim of the petitioner, the writ petition is disposed of by giving liberty to the petitioner to approach the Managing Director, M.A.D.A., Dhanbad by filing a fresh representation within a period of 3 weeks together with all supporting facts and documents for redressal of her aforesaid grievances. On receipt of such representation, the Managing Director, M.A.D.A., Dhanbad shall consider the same in accordance with law and after verification of the service records of the deceased employee pass a reasoned and speaking order within a period of 12 weeks thereafter which shall also be communicated to the petitioner.;
