Aparesh Kumar Singh, J. - (1.) HEARD learned counsel for the parties. The petitioner has come before this Court for quashing of a decision of the State Government contained in letter no. B -1 -423/03 404 dated 16th February, 2004, whereby the degree of Shiksha Visharad issued by Hindi Sahitya Sammelan, Allahabad has not been recognized by the Government of Jharkhand on the basis of which the petitioner was claiming appointment on being declared successful by J.P.S.C for the post of Primary Trained Teachers.

THE respondents have made categorical statements after verification from the State Council of Education Research and Training, Lucknow that Shiksha Visharad degree is not recognized by the National Council for Technical Education. Learned counsel for the Respondents -J.P.S.C. relies upon the judgment rendered by Division Bench of this Court in the case of Dilip Kumar Gupta & others and analogous cases reported in : 2005(2) JCR 293 (Jhr)., wherein also similar issues were under consideration and the same qualification of Shiksha Visharad obtained from Hindi Sahitya Sammelan, Prayag, Allahabad and its recognition were also subject matter of the writ petitions. Learned counsel for the Respondents - JPSC submits that Division Bench of this Court categorically held that in terms of Rule 2(Kha) of Rules 2002, under which the said examination were held the degree of Shiksha Visharad conducted by Hindi Sahitya Sammelan has not been treated to be a degree/diploma/certificate in teachers training as prescribed under the said Rule for enabling the candidates concerned to claim eligibility for appointment under the said advertisement. In view of the law settled in respect of the same matter there is no reason to take a different view by this Court. Therefore, the writ petition is devoid of any merit and it is accordingly dismissed.;
