JUDGEMENT

(1.) We considered the affidavits filed by the Department of Personnel and Training, who determines the vacancy of the I.A.S. Officers for the State which includes the I.A.S. Officers from promotional quotas of the State service as well as from the direct recruitment. After entertaining this writ petition which has been entertained sue motu after noticing shocking state of affairs in the State of Jharkhand of vacancies in I.A.S. cadre (apart from the shocking state of vacancies in most of the administrative service, the police service and other employment in the State of Jharkhand), 11 I.A.S. Officers have been given appointment out of which one has already expired, and therefore, 10 officers were made available for appointment in I.A.S. cadre in the State of Jharkhand. As per the affidavit of the Department of Personnel and Training in response to the order of this Court dated 18th June, 2012, the department determined number of vacancies on firm basis for select list in 2010 and 2011 for SCS category and for the select list of 2012 for non-SCS category. The year-wise vacancy determined by the Department of Personnel and Training for the year 2010 (SCS is 30), 2011 (SCS is 3) and 2012 (SCS is 3), total 36 in number. As per the Department of Personnel and Training, it is now for the Government of Jharkhand to send a proposal to the UPSC for taking necessary action for filling up abovementioned post then it is for UPSC to recommend a list of suitable officers for appointment against the above posts. Presently, we are taking the matter of promotional quota only and not of direct quota. In view of the stage where the process has reached, we direct the State Government to prepare a proposal by or before 31st March, 2013 and send it to the UPSC and further we are directing the UPSC to submit within what time they will complete the process of promotion. The respondent-State as well as the UPSC will give their stand by or before 2nd of April, 2013.

We are making it clear that time upto 31st March given to the State, is not the minimum time given to the State for doing the job, but it is the maximum period given and the State is supposed to do the job as early as possible which if, it can do or which may be done within a period of few days" only. The State shall complete its process at it's end and it will not delay the process and without delay, it will sent to the UPSC and UPSC may immediately thereafter take the step for convening the meeting of the selection committee for sending the recommendation of suitable officers for appointment on above posts. To give more emphasis, we make it clear that if complete process can be completed by 31st March, 2013 by both State of Jharkhand as well as the UPSC, then both may complete the process by 31st March, 2013.

So far as other issue is concerned which is with respect to the allocation of the Indian Administrative Service Officers from direct select list is concerned as per the detail given by the Department of Personnel and Training, in the year 2011, 8 officers were required to be given to the State of Jharkhand and as per the formula, the Department of Personnel and Training and UPSC may disclose that how many selected officers in Indian Administrative Service have been allocated to the State of Jharkhand as well as it may be disclosed that what was the quota identified for each particular year, year-wise and submit that in which year how many number of such candidates have been given to the State of Jharkhand and how many joined in the Jharkhand State. The UPSC and the Department of Personnel and Training shall also state the total number of deficit officers in the State of Jharkhand in the cadre of Indian Administrative Service as on 31.12.2012.;
