JUDGEMENT
-
(1.) Heard learned counsel for the petitioners and learned counsel for opposite parties.
The petitioners are aggrieved by Judgment and Order dated 3rd April
(2.) 2008 passed by learned Sub-Divisional Judicial Magistrate, Jamshedpur, in G.R. No. 2253 of 2002 / T.R. No. 1236 of 2008, whereby the petitioners were found
guilty for the offence under Section 498-A of the Indian Penal Code and were
convicted and sentenced for the same and the appeal filed by the petitioners was
also dismissed by the Appellate Court below by Judgment dated 2.7.2008 passed
by learned Add. Sessions Judge, Fast Track Court-III, Jamshedpur, in Cr. Appeal
No. 87 of 2008.
The interlocutory application has been filed on behalf of both the parties stating that the parties have compromised the case and they have decided
to live peacefully and accordingly, it was submitted that compromise between the
parties be accepted and the petitioners be acquitted of the charge. In the
interlocutory application, an affidavit has also been sworn by the informant-
opposite party No. 2, who is wife of the petitioner.
(3.) LEARNED counsel for the petitioner submits that the case has since been compromised between the parties and the informant has no objection in
acquittal of the petitioners. Learned counsel for the opposite party No. 2 also
admits the compromise between the parties and submits that the opposite party
No. 2 has no objection in acquittal of the petitioners.;
