Anticipatory bail application filed by petitioner Sunil Sharma and Amal Sharma @ Amal Kumar Sharma is moved by Sri Pran Pranay, learned counsel for the petitioners and opposed by Sri Shekhar Sinha, learned Additional PP. for the State. It is alleged that petitioner No. 2 namely Amal Sharma @ Amal Kumar Sharma snatched golden chain of informant's wife. Under the said circumstance, I am not inclined to enlarge petitioner No. 2 namely Amal Sharma @ Amal Kumar Sharma on anticipatory bail. Accordingly, his anticipatory bail application rejected.
(2.) So far petitioner No. 1 namely Sunil Sharma is concerned, only allegation against him that he assaulted informant's elder brother Dhananjay Pandey. But in the case diary, there is no injury report relating to aforesaid Dhananjay Pandey. Considering the aforesaid facts and circumstances, I allow the anticipatory bail application filed on behalf of petitioner No. 1 namely Sunil Sharma and direct him to surrender in the court below on or before 28th of February 2013 and in the event of his surrender, the learned court below is directed to enlarge him on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri K.J. Chopra, Judicial Magistrate, Deoghar in connection with Sarwan Police Station Case No. 142 of 2012 corresponding to G.R. No. 1205 of 2012, subject to the condition as laid down under section 438(2) of the Cr.P.C.;
