- (1.) HEARD the learned counsel for the appellant and Mr. Alok Lal for the respondent Insurance Co. In this appeal a limitation petition has been filed for condoning the delay. According to the office report, limitation expired on 7.10.2003 whereas the instant appeal was filed on 13.10.2003, perused the petition. For the reasons stated therein, let the delay in filing the appeal be condoned.
(2.) UNSUCCESSFUL complainant is the appellant before us against the judgment and order dated 2.9.2003 passed in Complaint Case No. 284/2003 on the file of the Distt. Forum. Ranchi, whereby the complaint was dismissed on the ground being not a consumer within the meaning of Section 2(1)(d) of the Consumer Protection Act. The Distt. Forum relying upon the decision of the National Commission as well as Apex Court has non -suited the complainant. In our view the Distt. Forum has rightly passed the order. We are not inclined to interferes with the same. Accordingly, this appeal is dismissed.;
