JUDGEMENT

Aparesh Kumar Singh, J. - (1.) HEARD , learned counsel for the petitioner and learned counsels for the respondent - State as well as respondent no. 9 - Accountant General. The petitioner has joined service as Vaccinator on 31.07.1962 in the Office of the In -charge Medical Officer, Chouparan, Hazaribagh and retired on 31.01.2002 as a Team Leader, Circle Gomia, within the Office of the In -charge Medical Officer, Gomia Block, Bokaro

IT is submitted by learned counsel for the petitioner that during the pendency of this writ petition the grievance relating to the payment of post retiral dues and arrears of salary have been redressed except the claim of the petitioner relating to grant of Assured Career Progression Scheme (ACP) has not been granted. In the circumstances, learned counsel for the petitioner prays that petitioner would be satisfied if liberty is granted to move before the competent authority for redressal of his grievance. In the facts and circumstances of the case, liberty is granted to the petitioner to file a representation before the respondent no. 6, Civil Surgeon, Bokaro so far as the claim relating to grant of ACP furnishing all the necessary facts and particulars as required by the competent authority within a period of three weeks. In case, such a representation is filed before the Respondent No. 6, (Civil Surgeon, Bokaro), he would consider the same in accordance with law and pass a speaking and reasoned order within a period of six weeks thereafter and the same shall be communicated to the petitioner. In case, the grievance of the petitioner is genuine and found any of the dues legally admissible to him, the same should be paid within four weeks thereafter. With the aforesaid observations and directions, this writ petition stands disposed of.;
