JUDGEMENT

(1.) HEARD Learned Counsel for the parties. It appears that under the Chhotanagpur Tenancy Act, 1908 and other relevant laws, land survey was ordered by issuing a notification in the year 1981. The petitioner's contention is that during the survey, some inquiry is required to be made by the officers which are not being made and they are not visiting the spot to verify the facts, therefore, the petitioner is seeking a direction against the respondents to adhere to law for survey so that correct entry is made in the revenue record.

IT is clear from the notification annexed along with the counter affidavit that a big task has been undertaken by the State Government for survey of land for which complete process has been prescribed in the law. Thereafter, the survey report will be published. In this case, according to the counsel for the State, final list has already been published relating to the large number of villages consisting the majority of the villages. By this writ petition, the petitioner is seeking a direction against the respondents directing them to follow the law. Such a direction cannot be issued by this Court under any assumption that the authorities will not follow the law. Otherwise also, the land survey matters is involving thousands and lakhs of persons and entries cannot be monitored by the High Court in the Public Interest Litigation. The aggrieved persons have sufficient opportunity under the law to move the authority concerned for correction of entries at the relevant point of time during the course of survey as well as thereafter. They also have remedy for correction. In view of the availability of the right to the person, we are not inclined to entertain this writ petition filed by one of the person who may project it to be a public interest litigation without having any authority on behalf of all the persons. Even any committee, if constituted, as stated by the counsel for the petitioner, will not make it a public representative so as to file a petition with respect to the land survey in the area specified in the notification consisting of several villages. This writ petition is therefore dismissed.;
