JUDGEMENT

(1.) I.A. No. 3783 of 2011.
(2.) BY way of filing this interlocutory application, the petitioners have prayed for a direction upon the respondent authority to give them consequential benefit including salary, revision of scale till attaining the age of 60 years i.e. from 1.10.2006 to 30.09.2008 in view of order passed by the Hon'ble Apex Court in SLP No. 18316 of 2006 (Copy of the said order annexed to this petition as Annexure -6 to this I.A.). The order passed by the Hon'ble Supreme Court in SLP is reproduced herein below;
Thus whether the respondents are the employees of the corporation or the employees of the State Government, their age of retirement is 60 years and they shall be allowed to continue in service till they attained the age of 60 years.
Whoever paid their wages till they attained the age of 58 years shall continue to pay their wages and allowances till they attain the age of 60 years.
It is also significant that before the learned Single Judge of the High Court, learned counsel for the Corporation had agreed that the case was squarely covered by the judgment dated 31.1.2005 passed in WPS No. 190 of 2005 and similar cases. In that judgment, the High Court had directed the State of Jharkhand and the Jharkhand State Mineral Development Corporation to implement the decision taken by the Board of Directors on 20.12.2004 to enhance the age of retirement of the employees from 58 to 60 years.
In light of the said order passed by the Hon'ble Apex Court, the case of the petitioners is also required to be considered by the concerned respondent authorities, as the petitioners were asked to retire after attaining the age of 58 years.

IN view of the above, let this I.A. be treated as representation of the petitioner and respondent authorities are directed to consider the case of the petitioner and take a decision on the basis of decision rendered by the Hon'ble Apex Court passed in SLP No. 18136 of 2006 within four weeks from the date of receipt/production of a copy of this order. Any decision, that may be taken in this regard, may be placed on record. Accordingly, I.A. No. 3783/2011 stands disposed of.;
