JUDGEMENT

Aparesh Kumar Singh, J. - (1.) HEARD learned counsel for the parties. This writ petition has been preferred by the petitioner for his retirement benefits like gratuity, employees provident fund, earn leave encashment etc. It is the case of the petitioner that he retired on 31st July,2009 as a manager working in the Ranchi Khunti Central Co -operative Bank.
(2.) THE respondents have appeared and filed their counter affidavit. In para 6 to 10 of the counter affidavit they have stated the details of the payment made to the petitioner and those, which are under process. They have further stated that a sum of Rs.2,58,270/ -on account of leave encashment has been paid by order no.1272 dated 7th August,2009, which has been received by the petitioner as well (Annexure -A to the said counter affidavit). They have further stated that a sum of Rs.23,346/ -has also been paid on account of group insurance by Advise no.623 dated 6th March,2010. So far as the employees provident fund amount is concerned, the respondents have forwarded the case of the petitioner to the office of Employees provident Fund Organization by letter no.628 dated 7th August,2009 (Annexure B to the said counter affidavit). The respondents have also stated in para 9 that a sum of Rs.2,36,827/ -has been transferred in the account of the petitioner on 30th April,2011 under the head of gratuity (Annexure -C to the said counter affidavit). So far as the claim of the petitioner relating to fixation of pay scale is concerned, the respondents have stated in para 10 that a committee is constituted by the Registrar Co -operative Society, Jharkhand, vide letter dated 10th February,2011, who is examining the records of the employees for recommendation of the scale of pay to such employees and once the fixation of the scale of pay is made, the petitioner shall also be paid the arrears, which he is legally entitled. In view of the aforesaid facts and circumstances, the grievances of the petitioner for the present has been redressed. However, it will be open to the petitioner to approach the respondent no.1, for fixation of pay and consequential arrears of gratuity, which shall be examined in accordance with law by the concerned authority. With the aforesaid observation and direction, this writ petition stands disposed of.;
