The petitioners by way of the present petition have prayed for issuance of an appropriate writ/order/direction for quashing and setting aside the order dated 24.09.2008 (Annexure-9) passed by the learned Sub-Judge-I, Dumka in Title Suit No. 40 of 2008, whereby the learned court below has rejected the application dated 27.06.2008, filed by the petitioner for dismissal of the suit on various count including the point of jurisdiction and cause of action.;
