JUDGEMENT

Aparesh Kumar Singh, J. - (1.) HEARD learned counsel for the parties. Petitioner has sought a direction upon the respondents to pay an amount of Rs. 3,03,316/ - against repair works of vehicles of Central Coal Fields Limited by the petitioner who is the Proprietor of Khalsa Garrage for the period 1993 to 2001.

LEARNED counsel for the petitioner has relied upon a communication contained at Annexure -1 dated 30.09.2003 issued by the Area Finance Manager (R.A.), Daltonganj addressed to the Project Officer (R), Central Coal Fields Limited, Rajhara Colliery in support of his contention that the pending bills have not been paid despite communication made between the officers of the respondent -C.C.L. It is the further contention of the petitioner that his representation contained at Annexure -2 and the legal notice contained at Annexure -3 have also not been responded to. Although the respondents have appeared and filed their counter affidavit but it appears that they have not taken any decision on the representation of the petitioner.

IN the circumstances, without going into the merit of the case, the writ petition is disposed of with liberty to the petitioner to file a fresh representation before the Respondent No. 2 General Manager, C.C.L., Rajhara Area, Central Coal Fields Limited with all facts and supporting documents for redressal of his aforesaid grievance within a period of four weeks from today. In case such a representation is made, the Respondent No. 2 General Manager, C.C.L., Rajhara Area, Central Coal Fields Limited shall consider the same in accordance with law and pass a reasoned and speaking order within a period of 12 weeks thereafter which shall also be communicated to the petitioner. Needless to say that if the claim of the petitioner is found genuine and admissible, the amount found admissible should be paid to him within a further period of six weeks thereafter. With the aforesaid observations and directions, this writ petition is disposed of.;
