JUDGEMENT

- (1.) 02/14.05.2012 Heard counsel appearing for the petitioners and counsel appearing for the State.
(2.) PETITIONERS are apprehending their arrest in connection with the case registered under Sections 147/148/149/447/353/323/324/333/ 307/379/504 of the Indian Penal Code. Counsel for the petitioners has submitted that the F.I.R. is lodged in this case in May, 2007 and it is further contended that it is difficult to identify the present petitioner amongst a huge mob of more than 100 people. It is also contended that the petitioners have been implicated in this case only because they are the members of Bhartiya Janta Party under the leadership of Devi Dayal Munda. It is further contended that the said Devi Dayal Munda has already filed a case against the informant party earlier under S.C./S.T. (Prevention of Attrocities) Act i.e. P.S.Case No.28 of 2007 and for this reason, the informant has implicated the present petitioners in this case. Counsel appearing for the State has opposed but not disputed the aforesaid contentions made by the counsel appearing for the petitioner. Considering the facts and circumstances of the case, I direct the petitioners namely Ranjeet Tiwari and Harishankar Mahto to surrender in the trial Court/Court below within a period of one month from the date of this order and if they surrender, the trial Court/Court below will release them on bail on furnishing bail bond of Rs. 10,000/ (Rs. Ten thousand) each with two sureties of like amount each to the satisfaction of Shri H.C. Narain, Judicial Magistrate, Ranchi in connection with Kanke P.S. Case No. 48 of 2007 corresponding to G.R. No. 1843 of 2007 with the conditions that one of the bailors will be local resident having immovable property within the jurisdiction of the district concerned and subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.;
