JUDGEMENT
Narendra Nath Tiwari, J. -
(1.) THE Petitioner is an accused in the case registered under Sections 384 and 385 of the Indian Penal Code.
(2.) LEARNED Counsel for the Petitioner submitted that though the Petitioner's prayer for bail was earlier rejected by this Court, he has remained in custody for about nine months; the first information report is against unknown; the Petitioner's mobile number was well known to the informant; he has been falsely implicated in the case with ulterior motive; there is no allegation of any transaction of money and as such, the alleged sections of the Indian Penal Code are not attracted and no offence is made out against the Petitioner; he has no criminal antecedent; he is a local permanent resident; there is no chance of his absconding. Learned A.P.P. opposed the Petitioner's prayer for bail, but after going through the case diary has not disputed the said contentions made by learned Counsel for the Petitioner.
(3.) REGARD being had to the facts and circumstances of the case, the Petitioner, abovenamed, is directed to be released on bail on furnishing bail bond of Rs. 10,000/(rupees ten thousand) with two sureties of the like amount, each, to the satisfaction of learned Chief Judicial Magistrate, Koderma in connection with Koderma (Telaiya) P.S. Case No. 405 of 2010, corresponding to G.R. No. 830 of 2010.;
