D.N. Patel, J. - (1.) COUNSEL for the petitioners submitted that suffice, it will be for the disposal of this writ petition, if a direction is given to respondent no. 2 to consider the case of the present petitioners (in both the writ petitions) in the light of the eligibility and seniority of the petitioners for promotion on the post of Sub -ordinate Education Service(SES) (Primary Section) in terms of the policy decision of the State Government, Human Resources Development Department, containing letter no. 967 dated 20th April, 1971 (Annexure 3 to the memo of the petition) because junior to the petitioners have already been promoted as stated in paragraph -7 of the memo of the petition.

COUNSEL for the respondents has submitted that they have no much objection to consider the case of the petitioners, if they are found eligible and suitable as per their seniority and the merits in accordance with law for the aforesaid posts. In view of the above submissions, I hereby, direct respondent no. 2 to consider the case of the petitioners for promotion on the posts of Sub -ordinate Education Service (SES) (Primary Section), in terms of the policy decision of the State Government, Human Resources Development Department, containing letter no. 967 dated 20th April, 1971, in accordance with law, rules, regulations, policies and enforceable Government orders, applicable to the petitioners and also keeping in mind the eligibility and seniority of the petitioners for promotion on the posts, in question. The decision will be taken by respondent no. 2 after giving opportunity of being heard to the petitioners or to their representatives as expeditiously as possible and practicable, preferably within a period of sixteen weeks from the date of the receipt of a copy of an order of this Court.
(3.) BOTH these writ petitions are hereby, disposed of, in view of the aforesaid directions. ;
