JUDGEMENT

(1.) Heard learned counsel for the petitioner and learned A.P.P. for the Prosecution.
Petitioner has been made accused for the offence under Sections 498A, 304B, 34 of the Indian Penal Code, in connection with Manatu (Tarhasi) P.S. Case no.23 of 2009, corresponding to G.R. No. 580 of 2009. The petitioner is the husband of the deceased and there is allegation against him to have subjected the deceased to cruelty and torture for the demand of dowry and to have committed dowry death. It is also alleged that without informing the family members of the deceased, the dead body of the deceased was cremated.
(2.) Learned counsel for the petitioner has submitted that petitioner has been falsely implicated in this case. It has also submitted that witnesses have stated before the police that the deceased died due to illness and at the time of cremation, family members of the deceased were also present. Learned counsel accordingly prays for bail.
(3.) From the case diary, it appears that the co-villagers of the petitioner have given the said statements before the police. In the facts and circumstances of the case, particularly in view of the allegation against the petitioner, I am not inclined to release the petitioner Abdul @ Abdul Wahid @ Lakhatua @ Lakhtua on bail.;
