LAWS(JHAR)-2011-1-148
HIGH COURT OF JHARKHAND
Decided on January 19,2011

RAJ KUMAR SINGH Appellant
VERSUS
Uco Bank, Respondents

JUDGEMENT

R.K. Merathia, J. - (1.) MR . V. Shivnath, learned senior counsel appearing for the Petitioner submitted that the Bank allowed the Petitioner to install and run 6 KVA Diesel Generator Set at the bank premises, but did not enter into agreement. In terms of the letter dated 26.9.2008 issued by the Zonal Office, such agreement was to be made for three years i.e. upto 30.09.2011, but in the meantime a notice inviting tender was issued by the Respondents -bank.
(2.) ON the other hand, Mr. Rajan Raj appearing for the Respondents -bank submitted that after introduction of Core Banking system the requirement of power supply through generator increased and therefore a notice inviting tender was issued for supply of power from 6 to 7.5 KVA D.G. Set. He further submitted that Petitioner participated in the tender process held on 23.4.2010 wherein after consideration of relevant aspects, Respondent No. 4 was given the work as he had offered lowest bid and Petitioner's offer was much higher. It appears that earlier the Petitioner was allotted work to install and run D. G. set of 6 KVA capacity. There is nothing to show that any agreement was made for three years. Moreover, it appears that when the requirement of the bank increased, a fresh tender notice was issued for supply of power by D. G. set of 6 to 7.5 KVA capacity in which Petitioner participated but became unsuccessful.
(3.) IN the facts and circumstances of the case, no grounds are -2 -made out for interference in this writ petition which is accordingly dismissed. However, no costs.;
