JUDGEMENT

- (1.) IN this writ petition, the petitioner has prayed for a direction on the respondents to immediately and forthwith release all the benefits to the petitioner in the light of the letter dated 21st March, 2001 issued by the Home Department, Government of Jharkhand, relating to grant of benefit to wife/family members of the martyr police personnel and government officials, who have lost their lives in anti Naxalite operation.
(2.) IT has been stated that the petitioner's husband was a police constable. He lost his life in a land mine explosion triggered by Naxalites on 12th June, 2009. The government has taken a policy decision to give benefits, including monetary grant and admissible salary of the deceased employee for the remaining period of his service to the widow/family members of such victim. The other benefits have been also provided by the said policy decision. The petitioner, who is widow of said martyr constable, applied for the benefits long back, but the same has not been considered and no decision has been taken till date. Learned J.C. to A.G. appearing on behalf of the respondents submitted that the petitioner's claim shall be considered without further delay and appropriate order shall be passed.

CONSIDERING the said submissions, this writ petition is disposed of, directing the Secretary, Department of Home, Government of Jharkhand Respondent no.2 to take final decision on the petitioner's claim and pass appropriate order, in accordance with law, within a period of one month from the date of receipt/production of a copy of this order. If the petitioner is found entitled to get the benefits as per the policy decision of the Government, the monetary benefit and other benefits, which the petitioner is entitled to get, shall be given to her within a period of six weeks thereafter.;
