JUDGEMENT
-
(1.) Mr. Rohit Roy, learned counsel appearing for the petitioner
submitted that petitioner made representation on 22.3.2010 for
acceptance of rent and issuance of rent receipt, but petitioner has not
received any order passed thereon.
(2.) Mr. M. S. Akhtar, appearing on behalf of the respondent
submitted that in the absence of counter affidavit, he is not in a position
to accept or controvert the submissions made by the petitioner. He
further submitted that it is to be seen whether the rent can be accepted
and rent receipt can be issued to the petitioner or not.
(3.) In the circumstances, petitioner is given liberty to make
fresh representation before the Circle Officer, Town Anchal, Ranchi
(respondent no. 5). If the prayer of the petitioner is found legally
tenable, orders for acceptance of rent and issuance of rent receipt willl
be passed. If it is found that such prayer is not legally tenable, the
reasons thereof should be communicated to the petitioner. This
exercise should be completed as early as possible and preferably
within a period of four weeks from the date of receipt of such
representation.;
