JUDGEMENT

Narendra Nath Tiwari, J. - (1.) IN this writ petition, the Petitioner has prayed for a direction on the Respondents to pay pension to the Petitioner along with statutory interest.
(2.) IT has been stated that the Petitioner retired on 4th January, 1998 from the services of the Respondents. After his retirement, he was entitled to get all admissible benefits/dues, but the Respondents did not pay anything to the Petitioner. The Petitioner, thereafter, had approached this Court in W.P.(S) No. 4424 of 2004. The said writ petition was disposed of, directing the Respondents to consider the Petitioner's claim and pass appropriate order either themselves or to refer the matter to the authority of the C.M.P.F. The Petitioner was also directed to vacate the official quarter, though the Petitioner had vacated the said quarter on 31st October, 2004. The Respondents, thereafter, released some amount, but they are still withholding the pensionary benefits of the Petitioner. Learned Counsel appearing on behalf of the Central Coalfields Ltd. submitted that almost all the dues of the Petitioner have been cleared and paid. If the Petitioner has still any grievance regarding deficiency in payment of the amount or for any additional payment, he should approach the appropriate authority. If the Petitioner files any representation regarding his claim, the same shall be considered and appropriate order shall be passed by the concerned authority.

HAVING heard the parties, this writ petition is disposed of, giving liberty to the Petitioner to file representation, along with a copy of this order, before the Project Officer, CCL, Swang Colliery ยช Respondent No. 3. On receipt of the representation, the said Respondent shall consider the same and pass final order, in accordance with law, within a period of six weeks from the date of receipt of the representation. If the Petitioner is found entitled to get pension or any other benefits, admitted arrears/monetary benefits shall be paid to him within a period of six weeks thereafter with statutory interest. If the amount(s) found payable to the Petitioner is/are not paid within the said period, the Petitioner shall be entitled to get additional compensatory interest @ 10% per annum till final payment.;
