JUDGEMENT

(1.) Heard learned counsel for the petitioner and learned A.P.P. for the Prosecution.
(2.) Petitioner has been made accused for the offence under Sections 147/148/149/364/302/379 of the Indian Penal Code and 17 of the C.L.A. Act, in connection with Lapung P.S. Case no. 5 of 2011, corresponding to G.R. No. 519 of 2011.
(3.) The case relates to triple murder by the persons belonging to extremist group and the FIR was lodged by one Mahabir Sahu, who is the father of one of the deceased. Witnesses to the FIR, is Kameshwar Sahu, who is father of another deceased, and the petitioner is not named in the FIR. Subsequently, the witness Kameshwar Sahu and his wife have stated that they had seen this petitioner tying the hands of their son and the murder was committed by the persons belonging to the extremist group. The other witnesses have also supported that the murder of the deceased persons was committed by the persons belonging to the extremist group. It appears that the name of the petitioner has not been taken by any one, to be a person who had assaulted the deceased. In the facts and circumstances of the case, I am inclined to release the petitioner on bail.;
