JUDGEMENT

- (1.) ANTICIPATORY bail application filed by Gyan Ratan, is moved by Sri P.K. Prasad, learned senior counsel for the petitioner and opposed by Sri S.K. Srivastava, learned Additional P.P. for the State.
(2.) IT is alleged that petitioner interfered with the official work of informant and his colleague who went to premises of petitioner for inspection on the direction of Managing Director, AIADA as to whether petitioner was violating the order of this Court passed in W.P. (C) No. 6042 of 2008. The aforesaid order has been annexed as Annexure6, which reveals that during the pendency of the writ application status quo with regard to possession of land in question was ordered to be maintained. Admittedly, the said land was allotted to petitioner's company which was later on canceled by AIADA. Against that the aforesaid writ application filed. A counter affidavit filed annexing an order passed by Managing Director, AIADA dated 04.10.2010 in which he directed the informant and others to inspect the said premises, though there is no subsequent order passed by this Court authorizing the Managing Director, AIADA for doing so. Petitioner being officer of Tata Steel Ltd. is in possession of the said land, therefore, the action of informant and others amounts to interference in their possession. Considering the same, I allow this application and direct the petitioner to surrender in the court below by 18th of March, 2011 and in the event of his surrender, the learned court below is directed to enlarge him on bail on his furnishing bail bond of Rs. 10,000/(Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Seraikella, in connection with Gamaharia P.S. Case No. 59 of 2010 corresponding to G.R. No. 808 of 2010, subject to the condition as laid down under section 438(2) of the Cr.P.C.;
