JUDGEMENT

(1.) THE petitioner is an accused in the case registered under Sections 302, 120B and 34 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submitted that the petitioner has been falsely implicated in the case; the petitioner is not named in the first information report; nothing incriminating has been recovered from the petitioner's possession; the petitioner had no knowledge about the case; subsequently, when he was arrested, he came to know about this case; coaccused Ashok Pandey, Sujit Gupta @ Sanjay Gupta, Dilip Sao, Santosh Burnwal, Dipak Rajak and Suman Singh, with identical allegation and material against, have been granted bail by this Court, as stated in Paras10 to 13 of the application; the petitioner is in custody since October, 2010.
(2.) LEARNED A.P.P. opposed the petitioner's prayer for bail and submitted that though the petitioner is identically placed with others, as far as the allegations are concerned, he is resident of West Bengal and there is likelihood of his absconding, if he is released on bail. However, he has not disputed the said contentions of learned counsel for the petitioner.
Regard being had to the facts and circumstances of the case, the petitioner, abovenamed, is directed to be released on bail on furnishing bail bond of Rs.10,000/ (rupees ten thousand) with two sureties of the like amount, each, to the satisfaction of learned Additional Sessions Judge, F.T.C.II, Hazaribagh in connection with S.T. no.447(A) of 2007, arising out of Barkagaon (Urimari) P.S. Case no.145 of 2006, corresponding to G.R. no.3449 of 2006.;
