JUDGEMENT

(1.) MR . Sinha, learned counsel appearing for the petitioner, submitted that pursuant to the inspection held on 23.4.2010 regarding 2010 -2011 sessions, the petitioner rectified all the deficiencies pointed out by DCI before the beginning of the session/studies, and had the petitioner been give opportunity after second inspection on 6.7.2010, it could have shown that it had rectified all the deficiencies. He further submitted that the students have been admitted as per the rules and regulation.
(2.) MR . Mohanti, learned counsel appearing for the D.C.I., submitted that vital deficiencies were detected by the inspecting team of the D.C.I. After the recommendation of the committee, D.C.I. reconsidered the case of the petitioner and held further inspection on 6.7.2010, but the petitioner did not rectify all the deficiencies pointed out.
In reply, Mr. Sinha submitted that the deficiencies were with regard to four teachers out of 90, regarding which D.C.I. could take a decision and it could be relaxed by the D.C.I. and so far as 63 dental chairs are concerned, they were installed after the second inspection was made on 6.7.2010 and prior to the beginning of sessions/studies. He further submitted that back volumes were also purchased after the said inspection.
(3.) BE that as it may. Keeping in view the interest of 100 students admitted under the orders of this court, D.C.I. is permitted to hold a fresh inspection/inquiry as early as possible and preferably within three weeks from today. If it is satisfied that admission of students have been done as per the rules and regulation for the academic sessions 2010 -2011 and they have completed their course properly and the petitioner had rectified all the deficiencies before the start of the sessions/ studies, it may allow the students to appear in the examination for the 2010 -2011 sessions.
It is made clear that the petitioner and all concern will cooperate in the inspection/inquiry failing which D.C.I. may pass ex -parte order. It is made clear that this order is being passed in the peculiar facts and circumstances and it will not be treated as precedent.
With these observations and directions, this writ petition stands disposed of.;
