JUDGEMENT

Prashant Kumar, J. - (1.) ANTICIPATORY bail application filed by Petitioner Ranjit Kumar Mohan @ Ranjit Mohan is moved by Sri. Nilesh Kumar and opposed by Mr. Azimuddin, learned Additional P.P.
(2.) IT is alleged that Petitioner took Rs. 1,53,000/ - from informant for arranging dealership of ACC Cement but he misappropriated said amount. Learned counsel for the Petitioner after seeking instruction from his client, submits that Petitioner is ready to pay the aforesaid amount to the informant without being prejudiced to his case. In view of the aforesaid submission, I allow this application and direct the Petitioner to surrender in the court below on 21.4.2011 and in that event the court below is directed to enlarge the Petitioner, above named, on bail on furnishing bail bond of Rs. 10,000/ - (Ten Thousand) with two sureties of the like amount each to the satisfaction of C.J.M. Gumla in connection with Gumla P.S. Case No. 59 of 2006 (G.R. No. 204 of 2006) subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure., subject to further condition that on that date the Petitioner will furnish a bank draft of Rs. 1,53,000/ - in the name of informant Zunnu Rain. The court below is directed to hand over the said bank draft to the informant on proper identification.
(3.) HOWEVER , it is made clear that aforesaid payment made by the Petitioner is without prejudice to his case.;
