JUDGEMENT

Narendra Nath Tiwari, J. - (1.) THE Petitioner, in this writ petition, has prayed for a direction on the Respondents to fit his pay in the appropriate pay scale with effect from 16th October, 1996 and 1st January, 2005.
(2.) IT has been stated that the Petitioner is entitled to the said benefits for the post of Assistant Rigman, Grade -II (Technical), which is Supervisory Grade -E, with effect from 16th October, 1996. He is further entitled to the pay scale of Assistant Rigman, Grade I (Technical & Supervisory Grade -D) with effect from 1st January, 2005. The Petitioner made oral requests before the concerned authority and filed representations, requesting him to pass appropriate order regarding the same, but till date no order has been passed by the concerned authority. Learned Counsel appearing on behalf of the Respondents submitted that the Project Officer, Rohini Project, Rohini of Central Coalfields Ltd. is the competent authority to consider the Petitioner's claim and pass appropriate order and if any representation is still pending or if the Petitioner files a fresh representation, his claim shall be considered and appropriate order shall be passed by the said authority without any further delay.

CONSIDERING the said submissions made by learned Counsel for the parties, this writ petition is disposed of, giving liberty to the Petitioner to file a fresh representation, along with a copy of this order, regarding his claim, before the Project Officer, Rohini Project -Respondent No. 4. On receipt of representation, the said Respondent shall consider the same and pass appropriate order in accordance with law within a period of six weeks from the date of receipt of the representation. If one or the other claim(s) of the Petitioner is/are found genuine, the arrears of monetary benefits shall be aid to the Petitioner in the appropriate scale within a period of six weeks thereafter. The Respondent shall pass appropriate order for fixation of pay scale etc. within the said period.;
