JUDGEMENT
-
(1.) The present application has been preferred under Section 438 of the Code of Criminal Procedure in connection with the offence registered with Gola P.S. Case No. 22 of 26l0, corresponding to G.R. Case No. 539 of 2010, for the offences punishable under Sections 363/366A of the Indian Penal Code, which is pending in the Court of learned Chief Judicial Magistrate, Hazaribagh.

Having heard learned Counsels for both sides and looking to the facts and circumstances of the case and also looking to Annexure-3 i.e. the statement recorded under Section 164 of the Code of Criminal Procedure, 1973 before learned Judicial Magistrate, 1st Class, Hazaribagh dated 8th March, 2010 and also looking to the tender age of the Petitioner and also looking to the fact that there is no antecedent of the Petitioner, I hereby enlarge the present Petitioner on anticipatory bail.
(3.) In view of the aforesaid facts, this anticipatory bail application is allowed. The Petitioner is granted anticipatory bail. In the event of arrest of the Petitioner in connection with Gola P.S. Case No. 22 of 2010, corresponding to G.R. Case No. 539 of 2010. for the offence punishable under Sections 363/366A of the Indian Penal Code, he shall be released on bail on executing a bond of Rs. 10.000/- (Rs. ten thousand only) with one surety of the like amount to the satisfaction of learned Chief Judicial Magistrate, Hazaribagh on the following conditions:
(a) The Petitioner shall remain present before the Court of learned Chief Judicial Magistrate, Hazaribagh on 28th February, 2011 in between 10:00 a.m. to 3:00 p.m.;
(b) The Petitioner shall co-operate with the investigation and make himself available for interrogation whenever and wherever required;
(c) The Petitioner shall neither hamper the investigation in any manner nor shall directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, so as to dissuade them from disclosing such facts to the Court or to any Police Officer;
(d) The Petitioner at the time of execution of bond, furnish his residential address to the Investigating Officer and the concerned Court and shall not change the residence till the final disposal of the case or till further orders;
(e) The Petitioner shall not obstruct or hamper the police investigation and not play mischief with the evidence collected or yet to be collected by the police.;
