JUDGEMENT
R.K. Merathia, J. -
(1.) MR . Manish Kumar, learned Counsel appearing for the Petitioner submitted that the Petitioner is running the college on the land in question since 1989 for which temporary recognition was being granted only for a period of one year, on the ground that the land is neither owned by the Petitioner nor leased for 30 years in its favour, and therefore, Petitioner requested the Tinplate Company to issue a letter to clarify the position. Accordingly, the letter dated 7.4.2008 was issued, which shows that the land was given to the Petitioner by the said company. He further submitted that the said company was given the land by Tata Steel Ltd., the lessee of the State Government.
(2.) ON the other hand, Mr. Anwar, learned senior counsel appearing for the J.A.C. Submitted that the recognition has not been given to the Petitioner for the session 2009 -11 onwards as the land neither belong to the Petitioner nor it has been leased in its favour for more than 30 years which are the conditions put by the State government for grant of recognition and it is up to the government to take decision in this regard. In the circumstances, Petitioner is given liberty to file a representation before the Secretary, Human Resources Department, Government of Jharkhand, Ranchi within two weeks from today on which a reasoned order in accordance with law will be passed after giving opportunity of hearing to the Petitioner as early as possible and preferably within a period of two weeks from the date of receipt of such representation. If the concerned Secretary is satisfied that the Tinplate Company has been given the land in question by Tata Steel Ltd. and the Tinplate Company has got no objection in running college on its land, it is expected that he will pass appropriate order directing the J.A.C. to grant recognition.
(3.) WITH these observations and directions, this writ petition is disposed of.;
