LAWS(JHAR)-2001-3-32
HIGH COURT OF JHARKHAND
Decided on March 29,2001

Abu Sayeed Appellant
VERSUS
B.A.University, Ranchi Respondents

JUDGEMENT

S.J.MUKHOPADHAYA, J. - (1.) THE wilt petition was preferred by petitioners for direction on the respondent to regularise their services/absorb them against the regular posts.
(2.) ACCORDING to petitioners, they are working on daily wage since long under the Dirsa Agriculture University, Ranchi but no step has been taken for regularisation of their services, though in earlier writ petition CWJC No. 1260/89 (R) direction was given by this Court to regularise the services of daily wage employees, including ten of the petitioners, who were also petitioners in the said case. The counsel for the University submitted that during the pendency of the writ petition, an Advertisement No. 2/2000 issued on 9.4.2000 to fill up a number of class -III and IV posts in the University. If one or other petitioner applied their cases will be considered. In the advertisement, it was also pointed out that the University decided to give age relaxation to the extent the daily wage employee performed duty in the University and postwise preference shown for experience.
(3.) HAVING regard to the facts and circumstances. I dispose of the writ petition with direction to the respondents to consider the case of such petitioners, who applied in pursuance of Advertisement No. 2/2000, for one or other post and give preference as mentioned in the advertisement. If the question of preference amongst sets of employees or outsiders is arises, the petitioners, who are working in the University, will get preference over the employees working under the State Government or any other organisation or outsiders, if they are equally situated. Similarly, it will be open to the University to give weightage to its daily wage employee on the basis of their total experience.;
