JUDGEMENT

Anil Kumar Choudhary, J. - (1.) Heard the learned counsel for the petitioner through Video Conferencing.
(2.) This writ petition has been filed with a prayer to issue appropriate direction upon the Civil Judge- I, Sr. Division, Ranchi for early disposal of Arbitration Application No. 04 of 2017. It is submitted by the learned counsel for the appellant that after change in the pecuniary jurisdiction of the Commercial Courts as a consequence of amendment of the law, the petitioner has already filed a petition for remittance of the said application under section 34 of the Arbitration and Conciliation Act, 1996 being the Arbitration Application No. 04 of 2017 to the Commercial Court which is sub-judice before the Civil Judge- I, Sr. Division, Ranchi and hence, the petitioner modifies his prayer and submits that appropriate direction be given to the Civil Judge- I, Sr. Division, Ranchi to pass appropriate order on the petition filed by the petitioner for remittance of the said Arbitration Application No. 04 of 2017 within a month after lockdown is over and court starts functioning normally, however, Mr. Prashant Pallav, learned counsel for the petitioner fairly submits that at present he does not have any copy of the said Petition filed with the prayer to remit the said application to the commercial court nor can he say that on which date such Petition has been filed by the petitioner.

Considering the aforesaid facts of the case, this Writ Petition is disposed of with the observation that if at all the petitioner has filed any petition for remitting the Arbitration Application No. 04 of 2017 to the Commercial Court, then the said petition will be considered by the Civil Judge- I, Sr. Division, Ranchi as early as possible preferably within a period of one month after the lockdown is over and court starts functioning normally.;
