JUDGEMENT
-
(1.) Having heard learned counsels for both the sides and looking to the facts and circumstances of the case, it appears that:-
(i) This Court while disposing of W.P. (S) No. 84 of 2009 vide order dated 20th April, 2009 had given the following direction in paragraph no. 3 of the aforesaid order:-
"3. Having heard the counsel for both the sides and looking to the facts and circumstances of the case specially that the petitioner is not inviting order on merits looking to his legal position under the law for getting the relief. Nonetheless, I hereby direct the concerned respondents to decide the representation which is preferred by the petitioner at annexure-13 to the memo of the present petition, in accordance with law, rules, regulations and policies and such other legal enforceable order passed by the respondents, applicable to the petitioner, as expeditiously as possible, practicable, preferably within a period of four months from the date of receipt of the order of this Court."
(ii) It further appears that in view of the aforesaid direction, the Principal Secretary of the Home Department, State of Jharkhand, Ranchi has already decided the representation of the petitioner and has passed a detailed speaking order dated 3rd April, 2010.
(iii) The decision taken by the Principal Secretary of the Home Department, State of Jharkhand, Ranchi is at Annexure-A to the showcause reply, filed by the opposite party-State.
(iv) Nothing is stated further by the petitioner by filing rejoinder to the show-cause reply, filed by the opposite party-State.
(2.) In view of the aforesaid facts, there is no willful disobedience of the order passed by this Court by the opposite parties and, hence, this contempt application is, hereby, dismissed.;
