JUDGEMENT

- (1.) Heard learned counsel for the petitioner and learned counsel for the State.
(2.) This is an application for grant of regular bail to the petitioner for the offence under Sections 364A/34 of the Indian Penal Code. It is submitted by learned counsel for the petitioner that petitioner is not named in the F.I.R. and subsequently, during investigation it is found that Ajay Kumar Sharma in collusion with Anand Kumar Berad and Md. Shoeb made plan for kidnapping the victim Himanshu Mandal for ransom and thereafter, he was kidnapped by them and kept in B. O. C. colony. It is further submitted that petitioner's name has come in this case only on the basis of the confessional statement of coaccused Ajay Kumar Sharma and in his confession he stated that Manoj Kumar Singh resident of B.O.C. Colony was asked for providing meal to the victim during detention, except that there is no evidence that petitioner was involved in the kidnapping of the victim. Petitioner is in custody since 07.092010 and the main coaccused namely Anand Kumar Barad, has already been granted bail by a Bench of this Court vide order dated 12.05.2010 in B. A. No. 2709 of 2010 and Ajay Kumar Sharma has been graned bail by a Bench of this Court vide order dated 22.04.2010 in B. A. No. 1265 of 2010 and as such, he may be enlarged on bail. 2 Learned counsel for the State opposed the prayer for bail. In the facts and circumstances of the case, petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/( Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Ranchi in connection with Khelari Case No. 50 of 2009 corresponding to G. R. Case No. 3412 of 2009, subject to the condition that one of the bailers should be the local residents having property within the jurisdiction of the court. Petitioner will appear once every month in Court on date fixed, otherwise his bail bound would be liable to be cancelled.;
