- (1.) Heard the counsel for the appellants in the limitation matter (I.A. No. 2127 of 2009) and also on the merit of the appeal.
(2.) This appeal has been filed by the appellant-company who is the employer assailed the award passed by the Labour court, Dhanbad under the Workmen's Compensation Act in Compensation Case No. 5 of 2007.
(3.) It appears that the deceased was a permanent employee and was working as 'Under Ground Miner Loader' in Basuria Colliery. On the unfateful date of accident, while he was on duty, the roof of the coal fell at the back part of his neck resulting serious injury and was admitted to hospital where he was given treatment and later on he died after about nine months.;
