JUDGEMENT

- (1.) Learned counsel appearing for the petitioner seeks permission to withdraw this writ petition with a view to prefer an appeal before the appellate authority under Section 7-I of the Employees' Provident Fund and Miscellaneous Provision Act, 1952. It is submitted by learned counsel for the petitioner that the appeal will be preferred as early as possible, but, as the management of the petitioner is from Central Government, it will take at least four weeks time, but till then, the respondents may not hurriedly recover any amount from the petitioner because the petitioner is not going to run away, if the petitioner is losing the appeal. The petitioner is financially controlled by the Central Government and they are working since 1984. The petitioner will also prefer a stay application before the appellate authority under Section 7-I of the Act, 1952 along with the memo of appeal and, therefore, the appellate authority may be directed to decide the appeal within stipulated time.
(2.) In view of the aforesaid submission and looking to the impugned order, which is an appellable order under Section 7-I of the Act, 1952, the petition is, hereby, disposed of as withdrawn. Liberty is reserved with the petitioner that it may prefer an appeal along with stay application before the appellate authority under Section 7-I of the Act, 1952. It is expected from the Regional Provident Fund Commissioner, Jharkhand, Ranchi that the appeal preferred by the petitioner, being financed by the Central Government, will dispose of the appeal on merits as expeditiously as possible and practicable, preferably within a period of four weeks from the date of receipt of the appeal memo and stay application.
(3.) The petitioner is directed to move before this Court, in case of any difficulty.;
