JUDGEMENT

(1.) Heard counsel for the parties and with their consent this application is disposed of at the stage of Admission.
(2.) The petitioner, who is a Fazil Degree holder, has claimed to be eligible and qualified for his appointment to the post of Urdu Teacher. The petitioner's contention is that in response to the advertisement published by the respondents, he had submitted his application, stating his qualifications and thereafter, he was called upon to appear in the written examination. However, in the final results, since his name did not appear, he applied under the Right to Information Act, seeking information and the reply which he has received (Annexure-5), categorically declares with reference to his Role Number, that he has been selected. The petitioner's grievance is that despite the fact of his being selected, he has not been given the appointment letter.

Learned counsel for the petitioner submits that the Fazil Degree which the petitioner holds, has been treated as equivalent to the degree of trained teacher and the respondent authorities cannot, therefore, refuse to acknowledge the professional qualification of the petitioner on the ground that it is not the eligible degree for the appointment of the trained teachers. Learned counsel in this context, refers to the Circular of the Government dated 24th March, 1967 (Annexure- 1).;
