JUDGEMENT

- (1.) Anticipatory bail application filed by petitioner, Pankaj Dikshit @ Pankaj Kumar Dikshit is moved by Sri Rajesh Kumar and opposed by Sri Pravir Chatterjee Additional P.P. Learned counsel for the petitioner submits that he is ready to keep O.P. No. 2, with all respect and dignity as his wife.
(2.) Sri Pravir Chatterjee learned counsel for the complainant submits that he has no objection, if the petitioner will be granted anticipatory bail on the condition that petitioner keeps O.P. No. 2 as his wife with all respect and dignity. Considering the agreement between the parties and aforesaid facts, I allow this application and direct the petitioner, above named, to surrender in the Court below on 10th January, 2011. On that the O.P. No. 2 will also remain physically present in the Court below. If the petitioner surrenders by that time, the learned Court below is directed to enlarge him on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri B.K. Tiwary, Judicial Magistrate, Dhanbad in connection with C.P. Case No. 2300 of 2009, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. The Court below is also directed to send O.P. No. 2 with the petitioner after taking an undertaking from the petitioner that he will keep O.P. No. 2 as his wife with all respect and dignity and there will be no torture on her in future. However, if the O.P. No. 2 has any grievance in future, then she may file an application before the Court below and the Court below after making proper enquiry will pass necessary order in accordance with law.;
