JUDGEMENT

- (1.)MR . Justice K.R. Udayabhanu, President -The appellant is the opposite party/BSNL, in CC 77/08 in the file of CDRF, Alappuzha. The bill issued by the appellant dated 7.3.2008 for a sum of Rs. 12,039 stands cancelled. The appellant is also directed to pay a sum of Rs. 500 as compensation to the complainant.
(2.)THE case of the complainant is that he was a subscriber of land phone connection and was a subscriber of broad band from 2006 onwards. He received the impugned bill directing to pay an amount of Rs. 12,039 for the period from 1.2.2008 to 29.2.2008. Rs. 10,160 of the above amount was for using the broad band. The above is very much excessive.
It is the contention of the opposite parties/ the appellants that the complainant is a subscriber to H/250 plan of broad band and the excess usage charge will be @ 0.90 ps. per MB. After deducting the free limit the balance was with respect to the jjjual chargeable usage.

(3.)SUBSEQUENTLY in the additional statement the appellant has admitted there was mistake and that the bill was wrongly issued.
