JUDGEMENT

(1.) THIS is a writ petition by Makhanlal Chaubdar Under Article 226 of the Constitution of India for quashing the transfer order dated August, 25 1989 (Annexure -5) on the ground that he has been made victim or recurring transfers in as much as within a period of one year he has been transferred 5 times.
(2.) THE petitioner is holding the post of Accountant under the Director, Treasury and Accounts, Rajasthan Jaipur. Prior to August 2nd, 1988, the petitioner was working as Accountant in the office of District Education Officer, Jhunjhunu. By order Annexure -1 dated 2nd August, 1988, he was transferred on deputation with District Rural Development Agency, Jhunjhunu. Annexure -2 goes to show that the petitioner did not join the office of District Rural Development Agency, Jhunjhunu and on 26 -10 -1988 he was posted in the office of the Chief Medical and Health Officer, Jhunjhunu. There also the petitioner did not join and on 7th November, 1988 by Annexure -3 he was transferred as Accountant in the office of Treasury Officer, Jhunjhunu. By another order dated 19th December, 1988, the petitioner was transferred from the office of Treasury Officer, Jhunjhunu to the office of the Chief Medical and Health Officer Jhunjhunu. Again by order Annexure -5 dated 25th August, 1989, the petitioner was transferred from the office of the Chief Medical and Health Officer Jhunjhunu to the office of District Education Officer Jhunjhunu. In his place, Sardar Singh Khethad was transferred from the office of District Education Officer, Jhunjhunu to the office of the Chief Medical and Health Officer, Jhunjhunu.
Above facts would go to show that the petitioner, who holds the post of accountant only, wants to take posting of his choice in a particular department. When he was transferred to the office of District Rural Development Agency, it did not suit his vested interests and he did not join that office When be was accommodated in another office of the Chief Medical and Health Officer, Jhunjhunu, he did not attend there. Now when he was posted in the office of District Education Officer he feels that it is comparatively a bad posting for him than the office of the Chief Medical and Health Officer, Jhunjhunu. These facts go to show that the petitioner has high vested interests at Jhunjhunu and it is surprising that the Director, Treasury and Accounts, Rajasthan, Jaipur has failed administratively to deal with properly such a Government servant who has developed vested interests and has been succumbing to his preasures to obtain posting at the same place Jhunjhunu and also in the office of his choice. This Court will not grant any relief to such a Government servant who pressurises the authorities to obtain posting at the same place and in his choice -office.
(3.) THE writ petition has no merit in it is here by dismissed with award of Rs. 3000/ - which are assessed as costs and the same would be payable to Shri Sardar Singh Khethad by the petitioner.;
