JUDGEMENT

ALOK SHARMA, J. - (1.) Pursuant to the advertisement dated 25.5.2018 for appointment to the post of Constable (G.D.), the petitioner applied online for the post in issue in 8th Battalion RAC at Delhi. The online application form were filled by the petitioner like many others through the E-Kiosk. In the said form it was indicated that the petitioner's category was SC as he indeed is. But it appears that owing to an error made by the person manning the E-Kiosk in the petitioner's online application the column of Ex-Servicemen was also ticked. The petitioner was thereafter admitted to the written examination under the Rajasthan Police Subordinate Services Rules, 1989 (hereafter 'Rules of 1989'). He passed the said examination and consequently as provided under the rules, he was called for Physical Standard Test (PST) and Physical Efficiency Test (PET).

When the petitioner presented himself for the aforesaid two tests on 8.9.2018 at Shri Pratap Yadav Stadium, Chitrakoot, Jaipur, he was disallowed from participating on the count of the fact that as per his online application aside of being a SC category candidate, he had also stated to be an Ex-Servicemen but was unable to so establish from the documents. The petitioner states that he submitted before the competent authority that ticking the Ex-Servicemen category column in his online application form was an inadvertent error attributable to the person manning the E- Kiosk and in fact he should be considered as a SC category candidate in regard to which he had the requisite document/s. The plea of the petitioner however went abegging and he was not allowed to participate in the PST/ PET in the process of the appointment to the post of Constables (GD).
(3.) In the aforesaid facts and circumstances, this petition has been filed on 15.9.2018. Hence this petition.;
