JUDGEMENT
Sangeet Lodha, Vinit Kumar Mathur, J. -
(1.) These contempt petitions have been filed by the petitioners alleging disobedience of the order dated 1.2.18 passed by a Bench of this Court in D.B. Special Appeals Writ No. 1098/08, 234/09 and 243/09.
(2.) By order dated 1.2.18, the special appeals preferred by the respondent University against the order dated 7.1.08 passed by the learned Single Judge of this Court in the matter of Gopal Krishna Mehra and Anr. v. Mohan Lal Sukhadia University and Another, (S.B. Civil Writ Petition No. 3811/99) and other connected petitions, were dismissed with the further direction that the State of Rajasthan shall make available necessary finances to the University for compliance of the directions issued by the learned Single Judge.
(3.) The directions issued by the learned Single Judge vide order dated 7.1.08 read as under:
"In these facts and circumstances, I deem it just and proper to direct the respondent University to reconsider the matter of grant of pay-scale of Rs. 700-1600, after taking into account the fact that petitioners were appointed as Professional Assistants with effect from 01.04.1980, to the petitioners who were subsequently appointed after selection as in- service candidates on the posts of Assistant Librarian. It is also ordered that while considering the matter of grant of pay-scale while treating the Professional Assistants and Assistant Librarians as equivalent, as observed by the UGC, the other material submitted by the petitioner for consideration of their case may also be considered. If the petitioners still require to give any document for consideration the same may be filed by way of representation to the University within a period of 15 days from the date of receipt of a copy of this order. Upon receipt of the representation and a certified copy of the order of this Court, the University may take final decision at its own level while treating the matter of the year 1997 and ignoring the fact that the State Government has refused to grant the pay-scale of Rs. 700-1600 to the petitioners and the decision may be taken within six months from the date of filing of the representation.
It is also made clear that this controversy is related to the year 1997, therefore, MOU will not come in way for taking decision by the University. However, the ad interim stay operating upon recovery shall remain in force till the decision is taken by the University and no recovery shall be effected from the petitioners in the meantime.
With aforesaid directions, the writ petitions are disposed of." ;
