SANJEEV PRAKASH SHARMA, J. - (1.) This interim bail application has been filed under Section 439 CrPC in connection with FIR No.40/2018 registered at Police Station Seemliya, District Kota Rural for the offences under Section 8 / 18 of N.D.P.S. Act.
(2.) Learned counsel for the petitioner submits that since father of the petitioner expired on 28.05.2019, therefore, the petitioner be released on interim bail.
(3.) Looking to the facts and circumstances of the case, I deem it just and proper to accept the interim bail application of the petitioner and he shall be released on interim bail from 08.06.2019 upto 05:00 P.M. of 19.06.2019 on the following conditions:- (i) the petitioner Hari son of Late Shri Kalyan shall be released on interim bail in the aforesaid FIR from 08.06.2019 upto 05:00 P.M. of 19.06.2019, provided he furnishes a personal bond in the sum of Rs.20,000/- together with two sureties in the like amount to the satisfaction of the trial court with the stipulation that he shall appear before that court on all subsequent dates of hearing and as and when called upon to do so. (ii) During the period of interim bail, the petitioner shall not commit any offence, and if commits, then this interim bail shall be deemed to be automatically canceled without reference to the court, and the authorities concerned would be free to take action against the accused-petitioner in accordance with law; (iii) The petitioner will surrender before the concerned court below or the concerned Jail authorities by 05:00 P.M. of 19.06.2019. If the petitioner does not surrender before the aforesaid court/authorities on completion of stipulated period, the concerned court/jail authorities shall be free to take action against him in accordance with law. ;
