SANGEET LODHA,J. - (1.) By way of this writ petition (PIL), the petitioners public- spirited citizens have sought directions to the respondents to maintain, upkeep, develop the entire Mandore Garden, a place of historical, cultural, religious and environmental significance for the city of Jodhpur, which is being subjected to gradual ravishment on account of deleterious inaction on the part of the Government officials, who are under statutory obligation to maintain it.
(2.) As a matter of fact, Mandore Garden is one of a few public gardens of the city, which besides providing the lung space to the residents of Jodhpur, is the site of numerous architectural and historical monuments, attracting tourists from all over the world.
(3.) A perusal of the material on record placed by the petitioners depicts that a place which is developed to provide lung spaces to the residents of city of Jodhpur is infested with uncleanliness and unhygienic conditions. The ponds situated in the Mandore Garden have become a dumping ground for all sorts of waste, which besides diminishing its beauty, is causing health hazard for the visiting residents and the tourists.;
