JUDGEMENT

- (1.) HEARD learned counsel for the petitioner.
(2.) WE have perused the record more particularly the inquiry report, order passed by the disciplinary authority and the order passed by the learned Tribunal. In the facts and circumstances of the present case, we do not find any jurisdictional error having been committed by the learned Tribunal while dismissing the Original Application filed by the petitioner. The charges against the petitioner were found proved and affirmed by the disciplinary authority. A look at the inquiry report clearly shows that the petitioner has virtually accepted the fact that he failed to discharge his duties of supervision leading to failure to detect the fact that the amount had not been deposited by Mr.Mukesh Verma, the dealing clerk, in respect of assessee M/s.Modern School, Jaipur towards the contribution of E.P.F. All that the petitioner has stated was that since Mr.Mukesh Verma was dealing with the accounts of the establishment for the past many years, therefore, whatever documents and papers were submitted by him were accepted by the petitioner as correct and he did not verify the same. In view of the above, the inquiry officer and the disciplinary authority rightly held that so far as the charge against the petitioner of supervisory negligence is concerned, the same stands proved. In the facts and circumstances, therefore, we are not inclined to interfere with these findings given by the inquiry officer and the disciplinary authority and the learned Tribunal has rightly affirmed the same. We do not find any jurisdictional error in the impugned order nor can it be said in the facts and circumstances that the present one is a case of no evidence. The writ petition accordingly stands dismissed summarily.;
