JUDGEMENT
Govind Mathur, J. -
(1.) - To assail validity of the order dated 24th December, 2008 passed by the Deputy Registrar, Board of Revenue, Rajasthan, Ajmer transferring the petitioner, an inspector of Land Revenue (Land Records) from Nathdwara District Rajsamand to Ajmer, this petition for writ is preferred.
(2.) The contention of learned counsel for the petitioner is that the transfer impugned is outcome of extraneous consideration. As per the petitioner, he is transferred at the instance of Shri C.P. Joshi, State President of Indian National Congress, who lost election from Nathdwara Legislative Assembly. It is also asserted that Shri Joshi made a statement that was published in a newspaper (Annxl.7) to the effect that he lost election only because of certain Government officials. It is also stated that the petitioner is in relation to winning candidate and therefore, he is subjected to transfer.
(3.) A transfer is always required to be made in administrative exigency and on objective considerations. While alleging mala fides, a strong foundation should be there and no one could be permitted to make reckless allegations against any person. Whatever allegations are made in present petition are absolutely ill-founded. As a matter of fact, the persons against whom allegations of mala fides are made are also not party to the proceedings. No adequate material is available on record to deviate the Court from the settled presumption that a transfer is administrative exigency if not proved otherwise.;
