JUDGEMENT

(1.) THE petitioner had participated in the selection process initiated by the respondents for the post of Prabodhak included in the Schedule appended to the Rajasthan Panchayati Raj Prabodhak Service Rules, 2008 vide advertisement dt. 31/05/2008.

FIVE years continuous teaching experience without break from a recognized educational institution/educational project is one of the conditions of eligibility for participating in the selection process initiated by the respondents under the Rules of 2008. The experience certificate of teaching placed by the petitioner on record Anx. 5 dt. 13/05/2002 of his experience from 1st July, 1996 to June, 1997 and thereafter, he joined another recognized educational institution on 04/08/2004 and a certificate to this effect has been placed as Anx. 6 dt. 04/08/2008 joined on 8th August, 2004.
It is not in dispute that as per Anx. 6 dt. 04/08/2008 the petitioner did not complete five years of teaching experience as required under the Rules of 2008 and so far as earlier teaching certificate of experience is concerned, it is for the period from 1st July, 1996 to June, 1997 and in no manner can be considered as there was a break in service. The rule clearly contemplates that 'one must have at least five years continuous teaching experience without any break of a recognized institution'. Indisputably, the petitioner is not eligible in terms of the Rules of 2008. As such, the candidature of the petitioner has rightly been rejected.
The writ petition is without merit and it is accordingly dismissed.;
